What the law says
Unauthorised construction is handled by the municipal or development authority under state building laws. A public nuisance can be stopped by an order of the Sub-Divisional / Executive Magistrate under Section 152 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 133 CrPC). A civil court can grant an injunction and damages for private nuisance or interference with light, air or a common wall. Noise is governed by the Noise Pollution (Regulation and Control) Rules, 2000 — loudspeakers are generally not allowed between 10 pm and 6 am.
